LIABILITY WAIVER AND RELEASE AGREEMENT
Capos Road Trip – May 24, 2025
Palm Beach Capos & SOS Community Express
This Liability Waiver and Release Agreement ("Agreement") is entered into by the undersigned participant (or parent/legal guardian if under 18), in connection with participation in the Capos Road Trip organized by Palm Beach Capos and SOS Community Express on May 24, 2025, from Palm Beach County, FL to Jacksonville, FL and returning the same day.
1. Acknowledgment of Risk
I acknowledge that travel by motor vehicle involves certain inherent risks, including but not limited to traffic delays, accidents, personal injury, illness, or property loss or damage. I understand and voluntarily accept all such risks associated with participation in the Capos Road Trip.
2. Waiver and Release
In consideration for being permitted to participate in the Capos Road Trip, I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release, waive, and discharge Palm Beach Capos, SOS Community Express, and their respective officers, directors, agents, employees, volunteers, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, or causes of action that may arise from or relate in any way to my participation in the trip, including but not limited to claims for personal injury, illness, death, property damage, or delays.
3. Delay Disclaimer
I acknowledge and agree that arrival time back in Palm Beach County may be later than expected due to traffic, unforeseen delays, or other circumstances beyond the control of the organizers. I expressly agree that Palm Beach Capos and SOS Community Express shall not be held liable for any inconvenience, missed connections, or losses arising from a late arrival.
4. Medical Treatment
I consent to receive emergency medical treatment in the event of injury or illness during the trip and agree to be financially responsible for any costs incurred.
5. Governing Law
This Agreement shall be governed by the laws of the State of Florida. Any disputes arising out of this agreement shall be resolved in a court of competent jurisdiction located in Palm Beach County, Florida.
6. Entire Agreement
This document constitutes the entire agreement and understanding between the parties. No oral representations or statements shall modify this Agreement.
